EB-1 Visa application approved for an extraordinary violinist from Moscow, Russia. Approved within two months of filing, well in advance of the posted INS processing time. She and her husband received their green cards within days of INS approval of the petition. The client was thrilled with the quick approval time and was able to make plans to visit her family during the holiday season. Thorough preparation and documentation of this client’s credentials facilitatied the INS officer’s review, and eventual approval.
EB-1 Visa application approved for an extraordinary violinist from St. Petersburg, Russia. This client originally received a job offer from an orchestra in Florida. When the orchestra’s management changed, neither the former nor the current artistic director would honor their previous job offer and assist with the O-1 petition. The client was forced to return home to avoid overstaying his current student status. Dismayed by the orchestra’s actions, and believing that the client was eminently qualified for EB-1 status, Ms. Goldenberg prepared the EB-1 petition while the client and his wife were in Russia. The application was approved nine months after filing and the client and his wife are free to work with whatever organization they choose after they arrive.
EB-2 with NIW Visa application approved for a software developer in the highly specialized area of image translation being developed for and used by the U.S. military in Iraq. The client is among the world’s elite OCR software developers for real-world images as evidenced by his many conference presentations, publications and original work. The INS approved the application and granted a waiver of the labor certification process based upon the profound impact his work has on the national interests of the United States, especially the troops serving in combat around the world. Two other law firms told this client that his work would not qualify for a National INtererst Waiver of the PERM process. Ms. Goldenberg’s skillful writing, thorough documentation and proper legal research resulted in a timely approval and green card for this client.
EB-3 Visa application approved after the client’s first attorney improperly documented the petition for a software engineer from India. The client first retained Ms. Goldenberg after receiving a “Notice of Intent to Deny,” generally referred to as a “NOID.” Usually, at this point, the INS intent on denying the application but for this one last opportunity to overcome their opinion that the case merits a denial. Ms. Goldenberg rehabilitated the existing file, obtained additional supporting docuentation and wrote a clear legal memorandum about why the case should be approved and that the evidence presented supported an approval. After supervisory review, this petition was approved. After years of uncertainty, the client and his family finally have closure and the security of remaining in the United States to raise their daughter and work.
Adopted child allowed to remain with his family in the United States. This is a situation in which a woman, who raised an infant dropped on her doorstep and loved as much as her own natural-born child, could not imagine immigrating to the United States without him. Yet, she had no birth certificate for him and had not legally adopted him in the Philippines. After her arrival, marriage and ultimate denial of her and her children’s green card applications, she and her husband retained Ms. Goldenberg. Ultimately, this case was resolved partially in immigration court and then by the INS. An attorney in South Dakota facilitated the official U.S. adoption as well. Now, the two boys are in high school, doing well and are becoming U.S. citizens along with their mother. This case was quite strategically challenging and required substantial legal research and novel thinking. This family is celebrating another holiday season together and is extremely grateful and thankful for the peace resulting from having this nightmare behind them.
